CUSTOMER SERVICE AGREEMENT

Terms & Conditions

Please review these legal provisions carefully before authorizing services with Stoney Creek Tree Service.

Effective Date: October 31, 2026

Welcome to Stoney Creek Tree Service. These Terms & Conditions constitute a legally binding agreement between Stoney Creek Tree Service ("Company", "we", "us", or "our") and the customer ("Client", "you", or "your"). By approving an estimate, executing a proposal, or allowing work to commence, you affirm that you have read, comprehended, and agreed to be bound by the terms, operating guidelines, and liability provisions outlined herein.

1. Company & Scope

Stoney Creek Tree Service provides professional arboricultural operations comprising tree removal, pruning and trimming, stump grinding, storm and emergency relief, and post-work cleanup/hauling. All services are performed in accordance with industry best standards and within the specific parameters detailed on your project estimate.

2. Estimates, Site Inspection & Hidden Conditions

Estimates are formulated based upon visual site inspections and are valid for thirty (30) days from the issue date. Stoney Creek Tree Service exercises reasonable professional care during on-site evaluations; however, we are not responsible for hidden or sub-surface conditions (including embedded metal, fencing, concrete, stones, or underground root voids) not reasonably apparent during initial visual review.

3. Scheduling, Access & Customer Responsibilities

Clients are required to ensure safe and clear operational conditions prior to our team's scheduled arrival:

  • Driveway and route access must remain cleared of vehicles, equipment, and personal belongings.
  • Pets and children must remain indoors during all active operations and equipment movements.
  • Clients must visibly identify and mark all private underground utilities (e.g., irrigation lines, invisible pet fences, low-voltage wiring).
  • Clients must obtain necessary municipal tree permits or conservation approvals unless otherwise agreed in writing.

4. Change Orders

Any additional or supplemental work requested outside the scope of the original estimate requires a mutually authorized written change order and may incur additional charges reflecting labor, machine time, and disposal.

5. Weather & Force Majeure

Tree work is inherently weather-dependent. Stoney Creek Tree Service reserves the right to postpone or reschedule operations in the event of high winds, lightning, torrential rain, heavy snow/ice, or unanticipated regional emergencies to protect personnel, machinery, and client properties.

6. Safety & Work Zone

The active job perimeter is a restricted hazard zone. For safety reasons, customers, household occupants, and visitors must remain strictly outside the demarcated work perimeter until our crew signals that all operations and cleanup are complete.

7. Property Protection & Damage

While we implement protective rigging and ground-protection measures, minor lawn or soil disturbance is an inherent byproduct of moving heavy equipment and tree material. Stoney Creek Tree Service is not liable for incidental sod compression, damage to unmarked underground utilities, or pre-existing structural wear.

8. Cleanup & Debris Disposal

Work areas are left broom-clean with cut wood and brush hauled away, unless the client specifically requested wood to remain on site. Stump grinding mulch and shavings remain on-site in the grind hole unless explicitly quoted and invoiced for removal.

9. Payments

A deposit may be required prior to scheduling. Final payment balances are due immediately upon project completion. We accept major credit cards, bank e-transfers, and checks. Overdue balances incur late fees of 2% per month (24% per annum). Accounts remaining delinquent may be forwarded to collection agencies.

10. Cancellations & Rescheduling

We kindly request at least 48 hours' notice for cancellations or non-emergency rescheduling. Cancellations initiated with less than 48 hours' notice may be assessed a nominal late cancellation fee to offset route planning and crew allocation.

11. Warranties & No Guarantee on Living Trees

Because trees and woody plants are biological organisms subject to weather anomalies, insect borers, diseases, and environmental stress, we cannot guarantee the continued health, longevity, or survival of living trees post-pruning or cabling.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the cumulative liability of Stoney Creek Tree Service for property damage, service interruption, or contract dispute is strictly capped at the total fee value of the agreed contract.

13. Indemnification

The client agrees to defend, indemnify, and hold harmless Stoney Creek Tree Service, its employees, and affiliates from all claims, losses, or legal liabilities arising from the client's failure to obtain mandatory permits, misidentification of property boundaries, or failure to flag private underground utilities.

14. Photo/Media Use

We periodically record photos or videos of active tree work for staff training and portfolio presentation. Media documentation focuses strictly on botanical elements without capturing identifying personal details. Clients may opt out by providing written notice prior to job commencement.

15. Dispute Resolution & Governing Law

These terms and all operations undertaken by Stoney Creek Tree Service shall be governed by and interpreted under the laws of the Province of Ontario and the applicable federal laws of Canada. Any legal dispute or proceeding shall be resolved exclusively within Ontario courts.

16. Severability & Entire Agreement

If any provision of this agreement is adjudicated as invalid or unenforceable, that specific clause shall be modified or severed, and all remaining provisions shall remain fully effective. This document constitutes the entire service understanding and supersedes all prior verbal or unwritten representations.
